Supremo recuerda que hay que separar las terrazas de las fachadas"},"content":{"rendered":"<div>La Sala Tercera del\u00a0Tribunal Supremo\u00a0ha recordado esta semana la vigencia de una disposici\u00f3n que considera ilegal situar una\u00a0terraza\u00a0junto a una\u00a0fachada\u00a0sin que medie el espacio suficiente para que una persona invidente pueda circular sin obst\u00e1culos.<\/div>\n<p>Esta norma, que a buen seguro puede causar m\u00e1s de un quebradero de cabeza a empresarios y concejales que no la hayan contemplado, es uno de los argumentos utilizados por dicha Sala de lo Contencioso Administrativo para estimar parcialmente un recurso de la Asociaci\u00f3n de Afectados por el ruido de Elche, anulando as\u00ed dos art\u00edculos de la ordenanza reguladora del ejercicio de actividades econ\u00f3micos de dicho municipio.<\/p>\n<p>El alto tribunal recuerda que una orden ministerial establece como condici\u00f3n general del itinerario peatonal accesible que \u201cdiscurrir\u00e1 siempre de manera colindante o adyacente a la l\u00ednea de fachada o elemento horizontal que materialice f\u00edsicamente el l\u00edmite edificado a nivel del suelo\u201d.<\/p>\n<p>Agrega que \u201cninguna duda debe ofrecer que la ocupaci\u00f3n del espacio inmediato a esa l\u00ednea de fachada o de la correspondiente a ese elemento horizontal, supone un obst\u00e1culo para quien siendo invidente no puede tomar como referencia la l\u00ednea de fachada o elemento horizontal y, en definitiva, una limitaci\u00f3n de su derecho de movilidad por los espacios p\u00fablicos cuales son las aceras\u201d.<\/p>\n<p>\u201cEsa limitaci\u00f3n u obst\u00e1culo -prosigue la resoluci\u00f3n- es lo que se origina con la ordenanza impugnada cuando en su art\u00edculo 63 permite autorizar la instalaci\u00f3n en aceras de terrazas pegadas a la alineaci\u00f3n de fachadas (art\u00edculo 63.b).i)), cuando para calles peatonales o de acceso restringido se contempla la instalaci\u00f3n de terrazas adosadas a fachadas o pegadas a la alienaci\u00f3n de ellas (art\u00edculo 63.b).i).), o cuando en el art\u00edculo 65 se contemplan diversos modelos de terrazas en posici\u00f3n interior, en aceras o en calles peatonales, parques, plazas o bulevares (art\u00edculo 65.1.1.a) y 2)\u201d.<\/p>\n<p>Advierte el Supremo que la circunstancia de que se atribuya en la ordenanza a los servicios t\u00e9cnicos municipales la decisi\u00f3n de la instalaci\u00f3n en aceras de terrazas en posici\u00f3n interior o exterior (art\u00edculo 63.1.b).iii) o en calles peatonales o de acceso rodado restringido (art. 63.1.b).iii), o de la que se atribuya tambi\u00e9n a dichos servicios la decisi\u00f3n del modelo de terraza (art. 65.2), \u201cpara nada impide que, de conformidad con lo hasta aqu\u00ed expuesto, concluyamos que los art\u00edculos 63 y 65, en cuanto contemplan autorizaciones de las llamadas terrazas interiores, infringen la normativa estatal de aplicaci\u00f3n y que por ello deben anularse\u201d.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La normativa vigente exige que haya espacio suficiente para que un invidente pueda pasar
